Terms of service
Version 1.0 · effective 2 November 2026 · NGOB Growers Club (“the Club”), operated by NGOB (Nou Gaan Ons Boer) (“NGOB”, “we”, “us”). Please read these terms carefully. By creating an account, ticking the acceptance box or placing any order you confirm that you have read, understood and accepted them.
1. What the Club is, and what it is not
1.1. The Club is a private, members-only association for adults who wish to have cannabis cultivated for their own personal, private use, as permitted by South African law relating to the private cultivation, possession and use of cannabis by adults.
1.2. NGOB does not sell cannabis. NGOB provides professional horticultural services: it leases or sub-leases cultivation space to you and cultivates, harvests, dries, trims, cures, stores, packs and delivers your plants for you (“the Services”). All amounts you pay are for the Services, the cultivation space and the inputs and labour used, and never for cannabis.
1.3. Products in the online store named “Cultivation Service – [cultivar]” are bookings of the Services. The grams you choose describe the allocation of your own harvested crop that is processed, packed and delivered to you. The “Premium” and “Popcorn” options describe the grade of your allocation.
1.4. The Club operates under the law as it stands from time to time. If the law changes, NGOB may change, suspend or end any part of the Club or the Services to stay within the law, and these terms change with it.
2. Definitions
In these terms: “Member” or “you” means an approved, verified adult member of the Club; “Crop” means the cannabis plants cultivated for you and everything harvested from them; “Allocation” means the share of harvested Crop identified and labelled for you; “Lot code” means the batch reference on your bag (for example L-2610-T1-RS); “Grow Record” means NGOB’s records of the cultivation of a batch (room, plants, feeds, climate, harvest date and weights); “Cultivation Methods” means indoor (in a building, with climate control and artificial lighting), greenhouse (under cover, with climate control, with or without supplementary lighting) and outdoor (in the open, in season); “POPIA” means the Protection of Personal Information Act 4 of 2013; “CPA” means the Consumer Protection Act 68 of 2008; “ECTA” means the Electronic Communications and Transactions Act 25 of 2002.
3. Membership
3.1. Membership is open only to natural persons aged 18 years or older. Membership is personal to you and may not be transferred, shared or used on behalf of anyone else.
3.2. To join, you must create an account, give true and complete details, accept these terms and, when asked, prove your identity and age with a valid South African ID, passport or driver’s licence. NGOB may refuse, suspend or cancel any membership at its discretion, including where verification is not completed.
3.3. Membership is currently free. If a membership fee is introduced, it will be announced to members in advance and is a fee for Club administration only. It is never consideration for cannabis.
3.4. You must keep your login details secret and tell us at once if you think someone else has used your account. You are responsible for all activity on your account.
4. Your Crop, and ownership
4.1. You are and remain the lawful owner of the Crop cultivated for you, from the time it is allocated to you until it is delivered or collected.
4.2. Plants are grown from genetics (seeds, clones or mother plants) donated to or held for Members without charge, or supplied by you. NGOB does not sell seeds or genetics. NGOB may advise you on cultivars, and the Living Library shows the cultivars available for cultivation from time to time.
4.3. Cultivation is carried out on NGOB’s premises in cultivation areas leased or sub-leased to Members, using any of the Cultivation Methods. Each Allocation is identified, labelled and stored separately under a Lot code, and the Grow Record for that Lot is available to you through Trace a bag.
4.4. Because plants are living things, NGOB cannot guarantee a yield, cultivar availability, potency, terpene profile or harvest date. Lab figures and descriptions on the website are indicative only.
4.5. If a harvest is lost through pests, disease, power failure, weather or any other cause beyond NGOB’s reasonable control, NGOB will tell you and, at its option, allocate Crop from a later harvest, credit your account or refund the Service fee for the affected booking.
5. Personal use only
5.1. Your Crop is for your own personal, private use in a private place. You warrant that you will not sell, trade, deal in, supply, distribute or otherwise commercialise any of it, and will not give it to anyone under 18.
5.2. You may not consume cannabis in any public place, drive or operate machinery while impaired, or take cannabis across any national border.
5.3. If you break clause 5.1 or 5.2, NGOB may terminate your membership immediately and without refund of any unused Service fees, and you indemnify NGOB, its owners, staff and service providers against all claims, losses, fines and legal costs (on the attorney-and-client scale) that arise from your conduct.
6. Bookings, fees and payment
6.1. A booking is made when you check out on the website. It is accepted only when NGOB confirms it and payment has cleared. NGOB may decline any booking, including where stock of a cultivar’s harvest is exhausted (“sold out”).
6.2. Service fees are shown in South African rand and include VAT where VAT is charged. Prices can change at any time, but a confirmed booking is charged at the price shown when you placed it.
6.3. If payment is not received within the time stated at checkout, NGOB may cancel the booking.
6.4. Loyalty stamps and member tiers (Novice, Expert, Master) are a goodwill benefit with no cash value. NGOB may change or end the stamp programme on notice, but will honour rewards already earned.
7. Delivery and collection
7.1. You instruct and authorise NGOB to deliver your Allocation to you, using a courier of NGOB’s choice (currently PUDO Locker-to-Door) acting on your behalf, or to make it available for collection at a Club location. Deliveries are made anywhere in South Africa.
7.2. Parcels are discreetly packed and sealed, and carry a Lot code. The courier may require the named Member to show ID on delivery or collection. Only you may receive your Allocation.
7.3. Delivery times are estimates. NGOB is not liable for courier delays, but will help you trace a parcel and will replace or refund a parcel that is lost or arrives damaged, if you tell us within 48 hours of delivery with photos.
7.4. If an Allocation is not collected, or cannot be delivered after reasonable attempts, within 1 (one) month of NGOB notifying you that it is ready, NGOB may destroy it, keep photographic proof, and is released from any further obligation for it.
8. Cancellations and refunds
8.1. You may cancel a booking free of charge until it is packed for dispatch. After that, cancellation is not possible because the Allocation has been processed for you.
8.2. Because each Allocation is a perishable, personal product prepared for you, it cannot be returned once delivered. This does not limit any right you have under the CPA where an Allocation is defective; tell us within 48 hours with photos and NGOB will replace it or refund the Service fee.
8.3. Refunds are paid to the original payment method within 10 business days.
9. Club shop: edibles and accessories
9.1. Smoking accessories (papers, grinders, pipes, storage and similar) are sold as ordinary goods and the CPA applies to them in the normal way, including returns of unused, unopened accessories within 7 days.
9.2. Edibles and other cannabis preparations are a processing service. Your own Allocation is prepared for you, on the same terms as the Services in clauses 1 to 8. They must be kept away from children and pets, are not to be used while pregnant or breastfeeding, and should be started at a low dose.
10. Health
10.1. Nothing on the website, in the Living Library or from NGOB staff is medical advice, and no product is offered to diagnose, treat, cure or prevent any illness. Speak to a doctor before using cannabis if you have a medical condition, take medication, or are pregnant or breastfeeding.
10.2. You use cannabis at your own risk. You accept that cannabis can cause impairment, and that individual reactions differ.
11. Visits to the farm
Members do not have open access to cultivation areas. A supervised visit may be arranged with NGOB in advance. Visitors must follow the safety and hygiene briefing given on arrival, may not enter another Member’s cultivation area, and may not take photos or video without permission.
12. Conduct, voting and community
12.1. Strain votes, write-ins and suggestions help NGOB plan future grows, but they are not binding on NGOB.
12.2. You must not misuse the website, post unlawful or offensive content, impersonate anyone, or try to access other members’ data or NGOB’s systems.
13. Confidentiality
NGOB keeps your identity, your bookings and the location of the cultivation areas confidential, and you agree to keep the location of NGOB’s premises, its methods and any non-public Club information confidential, during and after your membership.
14. Privacy (POPIA)
14.1. NGOB processes your personal information (name, contact details, ID and age verification, delivery address, booking and payment records) only to run your membership, carry out the Services, deliver your Allocation, keep the Grow Records and comply with the law.
14.2. Your information is shared only with service providers who need it for those purposes (such as the online store platform, payment provider and courier), each bound to keep it confidential, or where the law requires it.
14.3. You may ask to see, correct or delete your personal information, or object to its processing, by contacting us. Marketing messages are sent only with your consent, and you can opt out at any time. Full details are in our privacy policy.
15. Intellectual property
The NGOB name, logo, the Living Library, cultivar descriptions, photos, Grow Records, website and software belong to NGOB or its licensors. You may not copy or use them commercially without written permission.
16. Liability
16.1. To the extent the law allows, NGOB is not liable for any indirect, special or consequential loss, or for loss arising from your use or misuse of your Crop.
16.2. NGOB’s total liability to you for any claim about a booking is limited to the Service fee you paid for that booking.
16.3. Nothing in these terms limits any right you have that cannot lawfully be limited under the CPA.
17. Force majeure
NGOB is not liable for failing to perform because of events beyond its reasonable control, including load-shedding or power failures, fire, flood, storms, pests, strikes, courier failures, unrest, and acts or restrictions of any government or authority, including new laws on cannabis. If such an event lasts more than 90 days, either party may cancel affected bookings, and any fee paid for Services not performed will be refunded.
18. Suspension and termination
18.1. You may end your membership at any time by telling us in writing. Bookings already confirmed will be completed, or refunded if not yet packed.
18.2. NGOB may suspend or end your membership on written notice if you breach these terms and do not fix the breach within 7 days, or immediately for a breach of clauses 3.1, 5 or 12.2, for fraud, or where the law requires it.
18.3. On termination, any Allocation already harvested for you is delivered or made available for collection under clause 7.
19. Disputes
19.1. If you have a complaint, contact us first. We will respond within 5 business days and try in good faith to resolve it within 20 business days.
19.2. If it is not resolved, either party may refer the dispute to a court with jurisdiction, or you may approach the Consumer Goods and Services Ombud where the CPA applies.
20. General
20.1. These terms are governed by the law of the Republic of South Africa.
20.2. Accepting these terms online is a valid electronic signature and agreement under ECTA.
20.3. These terms, with the privacy policy and the details of each booking, are the whole agreement between you and NGOB. NGOB may update them by publishing a new version on this page and telling members by email or WhatsApp at least 14 days before the change takes effect, except where a change is needed sooner to comply with the law. Continuing to use the Club after that date means you accept the new version.
20.4. If any clause is found unlawful or unenforceable, it is treated as not written (pro non scripto) and the rest of these terms stay in force.
20.5. A delay or failure by NGOB to enforce a right is not a waiver of it.
20.6. Notices and domicilium: NGOB chooses its business address, which it will give you in writing on request, as its domicilium citandi et executandi, and ngogmsa@gmail.com for email notices. You choose the physical and email addresses in your account. A notice sent by email is treated as received on the business day after it is sent.
